Last updated:

These Terms & Conditions govern your use of the Heritage Banners website and any enquiry you submit through it. Please read them carefully before using the website or contacting us about a proposed flag, banner or ceremonial piece.

1. About Us

This website is operated by Heritage Banners, a UK-based workshop providing handcrafted flags, ceremonial banners and heraldic-inspired pieces.

Our contact details are:

If the business is operated by a limited company, the full registered company name, company number and registered office address must also be inserted on this page and elsewhere on the website where required.

2. Purpose of This Website

This website provides information about our work, examples of heritage-inspired designs and a means of contacting us regarding potential bespoke commissions. The website is not intended to operate as an online shop unless a separate ordering or payment facility is expressly made available.

Images, descriptions and examples shown on the website are intended to illustrate the style and nature of our work. Unless specifically stated otherwise, our designs are heritage-inspired pieces rather than certified reproductions of particular historical artefacts.

3. Website Enquiries

You may use our contact form, telephone number or email address to ask about a proposed commission. When making an enquiry, you should provide information that is accurate and sufficient for us to understand your request, such as:

Submitting an enquiry does not oblige you to proceed and does not oblige us to accept a project. It does not create a contract, confirm availability, reserve production time or constitute an order.

4. Bespoke Commissions and Quotations

Where we are able to consider your project, we may discuss design options, dimensions, materials, decorative finishing, expected timescales, delivery or collection arrangements and pricing.

Any quotation or project proposal will be based on the information available at the time it is prepared. A commission will only proceed once the specification, price and any applicable payment arrangements have been agreed in writing and we have expressly accepted the order.

Requests to alter a design, size, finish, delivery requirement or other specification after approval may result in revised pricing or completion times. We will notify you before proceeding with any material variation.

5. Design References, Heraldry and Symbols

Customers may provide reference material, sketches, logos, crests, lettering, emblems or other design instructions for consideration in a bespoke commission. You are responsible for ensuring that you are entitled to ask us to use any protected logo, emblem, design, trade mark or other material supplied by you.

We reserve the right to decline any proposed design or commission that we reasonably consider unlawful, infringing, misleading, offensive or unsuitable for our work.

Historic, ceremonial or heraldic references may be interpreted and adapted for the agreed design. Unless expressly agreed in writing, we do not warrant that a commissioned item is an exact archaeological, museum-certified or academically verified reproduction of an original historical object.

6. Colours, Materials and Handmade Finishing

We make reasonable efforts to represent colours, textures and decorative details accurately in website images and design discussions. However, colours may appear differently depending on screen settings, lighting, photography and the characteristics of the materials used.

Handcrafted and individually finished pieces may display minor variations in stitching, placement, texture or decorative finishing. Such variations are part of the nature of bespoke craft work, provided that the finished item remains consistent with the agreed specification.

7. Consumer Rights and Cancellation

Nothing in these Terms & Conditions affects any rights you may have under applicable UK consumer law.

If you enter into a contract with us as a consumer for goods made to your specification or clearly personalised for you, the usual statutory right to cancel a distance contract simply because you have changed your mind may not apply. Where this is relevant, we will make this clear before your order becomes binding.

This does not affect your legal rights where goods are faulty, not as described, unsuitable for a purpose made known and accepted before the order, or otherwise do not meet applicable legal requirements.

Any project-specific cancellation, deposit, payment, delivery and approval terms will be provided as part of the quotation or order confirmation before a commission is accepted.

8. Website Content and Intellectual Property

Unless otherwise stated, the content of this website, including its text, layout, branding, graphics, photographs and images of our work, is owned by or licensed to Heritage Banners and is protected by applicable intellectual property laws.

You may view the website and print or save extracts for your own personal, non-commercial reference. You must not reproduce, republish, distribute, modify, sell, license or commercially exploit website content without our prior written consent.

No permission is granted for third parties to use images of our designs or commissioned pieces as evidence of their own work or for misleading commercial purposes.

9. Acceptable Use of the Website

You agree not to use this website:

We may restrict access to the website or disregard enquiries where we reasonably believe these Terms have been breached.

10. Personal Information

When you contact us or submit an enquiry, we may collect personal information such as your name, email address, telephone number and details of your proposed project. We process personal information in accordance with our Privacy Policy.

Before submitting personal information through our contact form, please review the Privacy Policy so that you understand how your information is used, retained and shared.

11. Cookies

This website may use cookies or similar technologies that are necessary for its operation or, where applicable and with appropriate consent, for additional purposes. Further information is available in our Cookie Policy.

12. Third-Party Links

Our website may contain links to third-party websites for information or convenience. We do not control those websites and are not responsible for their content, availability, privacy practices or terms. You should review the applicable policies of any third-party website before using it or providing personal information.

13. Website Availability and Information

We aim to keep the website accurate and available, but we do not guarantee that it will always be uninterrupted, error-free or free from technical issues. We may update, suspend or withdraw content or functionality when reasonably necessary.

General information on this website should not be treated as a binding specification, quotation or confirmation of a commissioned item unless expressly incorporated into a written agreement between you and us.

14. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded under consumer law.

To the extent permitted by law, we are not responsible for loss or damage resulting solely from your inability to access the website, your reliance on general website content before agreeing a written specification, or the content of third-party websites linked from this site.

If you use this website for business or commercial purposes, we will not be liable for loss of profits, loss of business, business interruption or loss of business opportunity arising from your use of the website, except where liability cannot lawfully be excluded.

15. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to the website, our services or applicable requirements. The updated version will be published on this page with a revised last updated date.

The terms applicable to a specific accepted commission will be those agreed for that commission and will not be changed retrospectively without agreement where a contract has already been formed.

16. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you may also be entitled to bring proceedings in the courts of the part of the United Kingdom in which you live.
